Terms & Conditions

Tasting Fees. Tasting fees are not included in NCW Wine Tours. This allows for families to bring kids and non drinkers on the Tour. Passengers will be responsible for their own check outs.

Minimum booking: The minimum for a tour to operate is four people. If the tour does not have four people booked, you will be refunded your tour amount.


Food Allergies. While we will make accommodations for certain food preferences and allergies, we cannot guarantee that the food provided on the tour will be free from cross-contamination. 
Open Containers. Open alcohol containers on not permitted on the bus.  All open alcohol containers must be consumed on the premises of the designated wineries prior to reentry on the bus. 
Outside Food. You are welcome to bring and outside food items on the tour bus. However, we will only have cold storage available for food provided by the tour. Outside food may be permitted inside the wineries subject to the winery’s food and beverage license. 


Bottle Purchase. Bottle purchases on the tour are encouraged, but not required. Wine storage will be available for wine purchases during the tour. 


Intoxication. If you appear intoxicated, we cannot allow you to proceed on the tour. Please see cancellation policy if you become too intoxicated to continue during the tour.


Wheelchair Access. The tour bus is not wheelchair accessible.


Service Animals. Service animals are allowed.


Location Change. The wineries to be visited is subject to change without notice pursuant to the availability of each winery.


COVID-19.  Should a government COVID-19 shutdown be put in place or extended; or move into a zone restricting public gatherings, your tour will be cancelled, and a full refund will be issued. If masks are required by government mandate, masks will be required while on the bus and prior to seating at the selected wineries. Each winery may have their own rules regarding COVID protocols. Group sizes may be restricted based on government guidelines and the individual winery’s preferences.
Cancellation Policy.  Persons may be substituted within a tour without penalty. If a refund is requested there will be a 2% service charge from Square. There is no penalty if the tour is cancelled or changed 7 days prior to the date of the tour. There is a penalty if within 7 days of the tour you cancel the tour for any reason, or if the number of people changes to less than originally booked.   50% of total tour price if cancelled; 50% of individual tour price if a person(s) cancels.  

 

No refunds or credits are given for ‘no shows’, guests that miss the departure time or leave or are required to leave the tour before it is finished. There are no refunds for any changes to or cancellation on the day of the tour.


Voluntary Participation. I understand and confirm that my participation in our tour is voluntary. I am in good health and suffer from no physical or mental condition that would make me susceptible to injury or disability while participating in the tour. 


Understanding Risks. I am aware of the risks, dangers and hazards involved in my participation in the tour. I understand that the tours take place in public venues under conditions largely beyond the control of NCW Wine Tours LLC. Potential risks may include, but are not limited to, uneven walking surfaces, potholes, raised path edges, wet or slippery ground, steps, curbs, low lighting, narrow walkways, traffic movement, road crossings, diversions due to construction or exposure to weather conditions, etc.
Assuming Risks. I assume all risks involved in participation in the tour provided by NCW Wine Tours LLC. I accept personal responsibility for any liability, injury, loss, or damage in any way connected with my participation in the tour.


Release of Liability. I release, waive, discharge and covenant not to sue NCW Wine Tours LLC, its principals, affiliated entities, parent companies, subsidiaries, present and former employees, owners, officers, members, managers, partners, contractors, insurers, shareholders, and directors (collectively “Released Entities”) from any and all claims, actions, damages, liabilities, losses, costs, and expenses for death, injury, loss or damage of property, in any way arising out of my participation in NCW Wine Tours LLC, including, without limitation, any and all claims resulting from the negligence of the Released Entities.
Indemnity Agreement. I indemnify and hold harmless the Released Entities from any loss, liability, damage or cost that they may incur for losses and damages which may be brought against me or against any of them by anyone claiming to be injured (including death) or whose property is damaged as a result of my actions arising from or during a tour.


Promotion Release. I agree to grant to NCW Wine Tours LLC a royalty-free license to use my photographic, video, or digital likeness, in whole or in part, taken during a tour, solely for promotional, educational, and/or NCW Wine Tours LLC purposes.


Consent to Medical Treatment. I authorize NCW Wine Tours LLC to provide me with customary medical assistance, transportation, and emergency medical services as the result of injury or health condition. This consent does not impose a duty upon NCW Wine Tours LLC to provide such assistance, transportation, or services. I have the right to refuse medical assistance and understand NCW Wine Tours LLC will provide assistance if I am incapacitated. 


Binding Arbitration. In the event a dispute shall arise between the parties, it is hereby agreed that the dispute shall be referred to a Washington Arbitration & Mediation Service or alternate service by agreement of the parties; from the county wherein NCW Wine Tours LLC is located; for arbitration in accordance with the Washington Arbitration & Mediation Service Rules of Arbitration. The arbitrator’s decision shall be final and legally binding, and judgment may be entered thereon. Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award.


If any portion of this Waiver is held to be invalid, it is agreed that the balance of the Agreement will remain valid and enforceable.


By reserving a seat on our tour you acknowledge that you have read, understand and accept these terms and conditions before going on a guided tour with NCW Wine Tours LLC.
